Kroger $17 Million Prescription Drug Pricing Settlement (File by 12/21/2026)

Consumers who paid for prescriptions at Kroger using insurance between Dec. 9, 2018, and Aug. 23, 2026, may be eligible for a cash payment from a class action settlement. Kroger has agreed to pay $17 million to resolve claims that it failed to properly account for its savings club prices when reporting “usual and customary” prescription drug prices to insurers, a practice that allegedly caused insured customers to pay more than they should have.

Who Can File a Claim

To qualify, class members must:

  • Reside in the United States or its territories.
  • Have paid, in whole or in part, for one or more prescription drugs at Kroger or any of its affiliated pharmacies.
  • Have used prescription insurance benefits when purchasing the qualifying prescription(s).
  • Have made the purchase(s) between Dec. 9, 2018, and Aug. 23, 2026.

Settlement Payments

Eligible class members may receive a pro rata cash payment. The final amount will depend on each claimant’s qualifying prescription purchases and the total number of valid claims submitted.

How to claim a class action rebate

To claim a settlement payment, class members can file a claim online or print and complete the PDF claim form and mail it to the settlement administrator.

The claim deadline is Dec. 21, 2026.

Is proof required to submit a claim?

  • If the estimated out-of-pocket total purchase amount is $8,000 or more, class members must provide supporting documentation. This may include itemized receipts, invoices, statements, insurance documents or records showing the amount they paid for prescription drugs from Kroger.
  • If the estimated out-of-pocket total purchase amount is less than $8,000, class members do not need to provide proof. However the settlement administrator may ask for documentation to support the claim at a later date.
